Present petition has been filed under Section 528 of BNSS, 2023 for seeking issuance of direction to respondents No.2 to 6 to provide 'NOC' for renewal of an arms' licence.

Since the aspect of renewal or non-renewal of an arms' licence is a matter which would entail civil rights of an individual, hence, the present petition in the form of a criminal misc. for seeking direction to the authorities to act in a specific manner would not be maintainable. 3.

Faced with the above, learned counsel appearing on behalf of the petitioner seeks withdrawal of the present petition with liberty to avail alternative remedy, so advised, including the filing of civil writ petition before this Court.
