*** RAMENDRA JAIN, J. (ORAL) Prayer in this petition under Section 439 Cr.P.C., has been made for grant of regular bail to the petitioner, in FIR No.151, dated 22.07.2015, under Sections 420 and 120-B IPC, Police Station City Ferozepur, District Ferozepur (P-1).
Learned counsel for the petitioner contends that the husband of the petitioner is satisfying the claim of different creditors, after selling his property.
Learned counsel for the petitioner has failed to explain that how much amount is being paid to the creditors or deposited with SEBI by husband of the petitioner, for which purpose, he was released on interim bail initially for three months, which has been further extended till 02.08.2019. He has drawn attention towards order dated 01.03.2019 of the coordinate Bench of this Court passed in CRM-7219-2019 and SONIKA 2019.07.01 16:30 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-24499-2019 --2-- CRM-7220-2019 in CRM-M-16696-2018, whereby the husband of the petitioner has made payment of `19,89,750/- to various persons as per chart (Annexure P-20) in the above mentioned petition and further assured to make payment of `50.00 lakhs within three months. As per learned State counsel, total fraud committed by the petitioner, her husband and another co-accused is approximately `5400.00 crores (Fifty four hundred crores).
Considering the exorbitant amount of cheating and fraud disclosed by learned State counsel, the payment of `19,89,750/- made by husband of the petitioner after grant of interim bail is completely unjustifiable and meagre. Therefore, even husband of the petitioner does not deserve any further extension of interim bail. Dismissed.
However, at this stage, learned counsel for the petitioner prays for withdrawal of the instant petition. Dismissed as withdrawn.
