The petitioners have approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.129 dated 28.6.2019 at Police Station City Jagraon, District Ludhiana under Sections 420, 294, 506, 120-B of Indian Penal Code, 1860 and Section 13 of Punjab Prevention of Human Smuggling Act, 2013.

At the time of issuance of notice of motion the following order was passed: " The learned counsel for the petitioners submits that the matter basically pertains to some monetary transaction between the husband of petitioner No.1 namely Shri Darshan Lal Malhotra and the complainant and that the petitioners, who are the wife and two unmarried daughters PANKAJ KAKKAR 2020.12.16 19:52 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-25573-2020 (O&M) of said Darshan Lal Malhotra, have been falsely implicated simply to pressurize Darshan Lal Malhotra to shell out some money. Notice of motion for 16.12.2020.

Meanwhile, in the event of arrest, the petitioners be released on interim bail subject to their furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioners shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C." 3.

The learned State counsel upon instructions from ASI Atma Singh has informed that upon verification it has been found that no amount was ever deposited in the accounts of any of the petitioners and that they have already joined the investigation.

Having regard to the aforestated position especially that the present case appears to be a case arising out of some monetary transaction and that no amount is stated to have been deposited in the accounts of the petitioners, who are all ladies, the petition is accepted and the interim directions issued by this Court vide order dated 2.9.2020 are hereby made absolute subject to the condition that the petitioners shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 16.12.2020 ( Gurvinder Singh Gill ) pankaj Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No PANKAJ KAKKAR 2020.12.16 19:52 I attest to the accuracy and integrity of this document
