R.P. Nagrath, J. (Oral) The instant revision has been filed to challenge the concurrent findings of conviction recorded by the Courts below. In view of the observation made on 13.08.2015, learned counsel for the petitioner has handed over a demand draft no. 002783 dated 18.08.2015 amounting to ` 1,85,000/- in favour of the respondent to learned counsel for the respondent. Learned counsel for the respondent submits that the respondent is present in person and his claim in the instant revision would be satisfied if additional amount of ` 15000/- is paid. That amount has also been paid in cash to the respondent by learned counsel for the petitioner.
There is otherwise no challenge to the concurrent findings of conviction reached by the Courts below. The petitioner is in custody since 04.08.2015.
In view of the above, instant revision is dismissed on merits and partly allowed qua sentence by reducing the sentence from one year of rigorous imprisonment for offence under Section JITENDER KUMAR 2015.08.21 16:47 I attest to the accuracy and integrity of this document
CRR No. 2935 of 2015 -2138 of the Negotiable Instruments Act to the period already undergone by the petitioner and setting aside the compensation of ` 1,85,000/- which was imposed as part of punishment. The petitioner be set at liberty forthwith if not required in any other case.
