Amir Singh v. Mangta Singh

CRR-2943-2015 Amir Singh v. Mangta Singh Statement of Mangta Singh (Ex. Serviceman), aged 67 years, son of S. Kirpa Singh, resident of House No. 31, Kot Pala Singh, Gali Jamanwali, Taran Taran Road, Amritsar, on SA. I had filed a complaint under Section 138 of the Negotiable Instruments Act, 1881 (for brevity, 'the Act') against Amir Singh, petitioner. After trial, Amir Singh was held guilty under Section 138 of the Act and ordered to undergo RI for two years besides payment of fine of Rs. 1,000/- and in default thereof to undergo further simple imprisonment for one month. The appeal filed by the petitioner was dismissed by learned Additional Sessions Judge (Fast Track Court) Amritsar, vide judgment dated 10.11.2014.

Since the petitioner was not present at the time of pronouncement of the judgment by the Appellate Court, therefore, non-bailable warrants for securing his presence were issued and later he was arrested on 23.6.2015. Due to intervention of the respectable of the locality, I have resolved my dispute with the petitioner and effected a compromise and in lieu thereof I do not want to get back the amount due towards the petitioner. I have no objection if the conviction and sentence of the petitioner are set aside and he is acquitted of the charge levelled against him.
