**** RITU BAHRI, J. (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of FIR No.07 dated 15.01.2017, registered at Police Station City-II Malerkotla, District Sangrur, who has been booked for having committed the offences punishable under Sections 406 and 498-A IPC.
With the assistance of Mr. Sachin Jain, Mediator, the matter has been compromised between the parties.
Learned counsel for the petitioner has placed on record the copy of settlement/compromise effected between the parties on 02.05.2017, Naresh Kumar 2017.05.19 11:24 I attest to the accuracy and integrity of this document Chandigarh which has been duly signed by both the parties.
CRM-M-7249-2017 -2Pursuant to above-said compromise, learned counsel for the petitioner has handed over a demand draft of `50,000/- and two post dated cheques, total amounting of `75,000/-, to learned counsel for respondent No.2, today in the Court.
Learned counsel for the parties submit that even the divorce has been granted between the parties.
In view of the above-said facts, order dated 03.03.2017, passed by this Court whereby the ad-interim anticipatory bail was granted to the petitioner is made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions as envisaged under Section 438 (2) Cr.P.C.
Registry is directed to release the itigation expenses of `25,000/- deposited by the petitioner to respondent No.2 forthwith. Accordingly, the petition stands disposed of.
