*** The case has been taken up through Video Conferencing. In compliance of the order passed by this Court on 1.9.2020, the petitioner has surrendered in the trial Court and has been granted interim bail. This fact is conceded by learned State counsel on instructions from ASI Baljinder Singh.

Under such circumstances, the interim bail granted to the petitioner on 1.9.2020 is made absolute, subject to the following conditions :- (i) He shall appear in the Court on each and every date of hearing.

(ii) He shall not give any threat or intimidation to the prosecution witnesses.

(iii) He shall not leave India without prior permission of the Court.

(iv) He shall surrender his Passport before the PARVINDER SINGH 2020.12.02 15:51 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-25449 of 2020 Investigating Officer and if he is not having Passport then shall file the affidavit in that regard. In case the petitioner violates any term and condition on which the bail has been granted to him, the prosecution would be entitled to apply for cancellation of bail.

It is observed that the trial Court may initiate proceedings under Section 446 Cr.P.C. against the petitioner and his earlier surety and impose considerable amount as penalty upon them for delaying the trial on account of absence of the petitioner from the Court without any intimation. A copy of this order be sent to the Court concerned through District and Sessions Judge of the District for information and necessary compliance.

The petition stands allowed accordingly.
