In the light of contentions of the two sides, since the case of the petitioner as per the policy of the respondent/State (Annexure P1) falls within the ambit of heinous crimes for being found guilty of murder of a child below 14 years of age and the petitioner himself being adult and thus, under this policy out of the actual sentence of 12 years the petitioner has already undergone actual imprisonment for a period of more than 15 years and thus, in the light of the own stand of the State that it was vide orders dated 17.07.2013 the RATTAN PAL SINGH 2016.02.27 12:44 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court



    respondent/State had declined the prayer of the petitioner prisoner Piara Singh for his premature release and that as per the policy of the State the same can only be considered after two years of the same, and thus, the petitioner qualifies this parameter so laid down in the policy.

Mr. Gurveer Sidhu, Asstt. Advocate General, Punjab has made a statement that the respondent/State would take up the case for premature release of the petitioner with the competent authority and the same shall be disposed off within a period of one month from today.

In view of the undertaking given by learned State counsel, the petition stands disposed off.

However, in case the respondent/State fails to abide by its undertaking, the petitioner reserves his right to invoke the jurisdiction of this Court. #  !$
