The petitioners assail the correctness of the order passed by the trial Court refusing to appoint Local Commissioner. 2.

The two different Division Benches of this Court in Rajender Prasad vs. Santosh Kumar and others' 1979 PLJ 562 and 'Malkiat Singh vs. Narinder Singh and another' 1990 (2) PLR 191 have consistently held that against such order, the revision petition would not be maintainable. Even otherwise, the construction has already been completed and the defendant No.1 has started residing in the same house. 3.

In view of the aforesaid facts, no ground is made out to interfere. Hence, the present revision petition is dismissed. (Anil Kshetarpal) Judge July 04, 2022 "DK"
