CHANDIGARH CRR No. 2991 of 2015 Date of decision : 08.01.2016 Bablu @ Ravi ....Petitioner V/s State of Haryana ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present revision petition is directed against the order dated 04.07.2015 passed by Additional Sessions Judge, Hisar upholding the order dated 24.04.2015 passed by Principal Magistrate, Juvenile Justice Board, Hisar whereby application for release of juvenile on bail has been rejected. Learned counsel for the petitioner has relied upon judgment reported as Ankit Upadhyaya vs. State of Chhattisgarh 2014(9) RCR (Criminal) 1609 in support of his contention.
I find no merit in the case. It appears that a murder of one Ishwar was committed by some unknown person. Later, investigating agency found that deceased had been murder by five accused including the petitioner. Out of them, three were declared juvenile. Petitioner sought bail before Juvenile Justice Board. It considered the Social Investigation Report and found that petitioner remained in such association which led to the crime. Petitioner preferred appeal before the Additional Sessions Judge, Hisar. He AJAY KUMAR 2016.01.14 15:59 I attest to the accuracy and authenticity of this document
CRR No. 2991 of 2015 came to the conclusion that, if released on bail possibility of coming in contact with criminal elements could not be ruled out. The prosecution took the stand that murder has been committed in gruesome manner as body of the deceased was dismembered and scattered between railway platform and grain market. Judgment in Upadhyaya's case (supra) cannot help the case of the petitioner. Considering facts and circumstances of the case, I am of the considered view that revision petition is without any merit and is hereby dismissed.
