RAMENDRA JAIN, J. (ORAL) Petitioner-tenant has filed this revision against the judgment of Appellate Authority dated 26.03.2019, dismissing his appeal, affirming the order of learned Rent Controller dated 04.05.2018, whereby he was directed to hand over vacant possession of demised premises to respondent-landlord within three months.
Learned counsel for the petitioner submits that he does not challenge the judgment and order of the authorities below on merits, however, seeks three months' time to vacate the demised premises. In view of above request, petitioner is granted three months' time from today to vacate the demised shop, subject to deposit of up-todate arrears of rent within a period of two weeks from today. In case, petitioner does not vacate the shop within three months from today, he shall pay mesne profits @ `7500/- per month, failing which the same RISHU KATARIA 2019.09.03 15:07 I attest to the accuracy and integrity of this document
CR-5134-2019 (O&M) -2shall be recoverable from his movable and immovable assets, whatsoever. Petitioner is directed to file affidavit in this respect before the executing Court within two weeks from today.
It is, however, made clear that in case, this order is not complied with by the revisionist in its letter and spirit qua payment of arrears of rent, in that eventuality, Executing Court shall proceed with the execution and take all positive steps to get the demised shop vacated from him along with recovery of use and occupation charges aforesaid. Disposed of.
