Learned counsel for the petitioner submits that application moved by the Bank for taking over possession of the property has been declined. However, a perusal of the order reveals that liberty has been granted to the bank to move a fresh application after issuing fresh notice under section 13(2) of the SARFAESI Act after complying with the provisions. A query has been put to learned counsel whether fresh application has been moved. He submits that same is likely to be filed shortly after complying with all the necessary provisions. In view of above, we dispose off the writ petition with the direction that in case any fresh application is moved, the District Magistrate shall decide the same expeditiously preferably within one month.
