The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 07.02.2022 whereby request of the petitioner for settlement of accounts for crop year 2018-19 has been declined.

Short reply by way of affidavit dated 30.10.2023 on behalf of respondents No. 3 and 4 is taken on record. Registry is directed to tag the same at appropriate place.

Learned counsel for respondents No. 3 and 4, at the outset, submits that final rates have not been determined by Government of India, thus, respondents are unable to finalize accounts of the petitioner. CWP-11503-2023 -2- 2023:PHHC:149174 submits that petitioner has not submitted complete documents, thus, agency is unable to calculate dues of the petitioner. 3.

Faced with this, learned counsel for the petitioner submits that grievance of the petitioner, at this stage, would be redressed if respondents No. 3 and 4 are directed to release a sum of Rs. 13.81 lakh which has provisionally been assessed as payable by respondents. 4.

Without commenting upon merits of the case, the respondents No. 3 and 4 are directed to release a sum of Rs. 13.81 lakh to petitioner as provisionally assessed. It is made clear that if any amount out of aforesaid amount has already been released, it would be deducted from the said amount.
