2023:PHHC: 079200 CRM-M-26833-2023 -26.
In the present case, investigation already stands concluded with the filing of challan followed by framing of charges and the petitioner has already suffered incarceration for a period of almost 5 months. Moreover, no prosecution witness has been examined so far, thus the trial is going to take some time, besides it, the petitioner is not involved in any other case of similar nature. Considering the aforesaid, I find no justified reason to extend the incarceration of the petitioner. 7.
In view of the above, without commenting upon merits of the present petition, the same is allowed. Petitioner is ordered to be released on bail subject to his furnishing of adequate bail bonds/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate.
