On 20.04.2026, the following order was passed: "Learned counsel for the parties submit that an amicable settlement has been arrived at, whereby the appellant shall pay a sum of Rs.7,00,000/- towards full and final settlement of all claims of the respondent insofar as the present lis is concerned.

Learned counsel for the appellant prays for two weeks' time to produce a demand draft for the said amount. Adjourned to 04.05.2026.

To be taken up in the urgents."

Thereafter, on 04.05.2026, it was stated that the appellant is on his way with the demand draft of Rs.7,00,000/-. However, he did not come present.

Today, no one has put in appearance on behalf of the appellant despite the case having been called twice. It appears that the appellant is only buying time and is not interested in pursuing the appeal. That being so, this Court is choiceless but to dismiss the appeal for non-prosecution. 4.
