Petitioner seeks anticipatory bail in case vide FIR No.78 dated 14.03.2026 under Section 108 of Bharatiya Nyaya Sanhita (B.N.S.), 2023, Police Station, Manesar, District Gurugram. This is the first petition for anticipatory bail.

On 28.04.2026, following order was passed:- Petitioner seeks anticipatory bail in FIR No. 78 dated 14.03.2026 under Section 108 Bharatiya Nyaya Sanhita, 2023, Police Station Manesar, District Gurugram, Haryana. This is the first petition for anticipatory bail. Learned counsel for the petitioner submits that petitioner was senior of the deceased in her office and the FIR alleged that he misbehaved with her, abused her, came to her flat and also touched her inappropriately; further that he pressurized the deceased to buy a new phone for him on which account deceased committed suicide. It is submitted that petitioner was innocent and had committed no offence.
Even if the allegations in the FIR were accepted as correct, essential ingredients of the offence under Section 108 BNS were not attracted as the acts of the petitioner could not be termed as instigation, abetment or incitement to commit suicide. There was no mens rea on part of petitioner to commit the offence. He further submits that the matter had since been compromised with the complainant, sister of the deceased and in this HARPREET SINGH CHAUHAN 2026.05.
CRM-M-23214-2026 (O&M) context, refers to compromise deed dated 06.04.2026. He urges that petitioner was ready and willing to join investigation.
Notice of Motion.
Mr. Vikas Bhardwaj, AAG, Haryana, accepts notice on behalf of Respondent No.1-State and opposes the prayer of anticipatory bail on the ground that there were serious allegations against the petitioner and his custodial interrogation would be required for effective investigation. In the facts and circumstances of the case, petitioner is directed to appear before the Investigating/Arresting Officer and join investigation within one week or as and when required. In the event of his arrest, the Investigating/Arresting Officer shall release the petitioner on interim anticipatory bail on furnishing personal/surety bonds to his/her satisfaction. The petitioner shall also abide by the conditions as envisaged under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. State is directed to file status report on 26.05.2026. 3.
Status report by way of affidavit of affidavit of Virender Singh, HPS, Assistant Commissioner of Police, Manesar, Gurugram on behalf of respondent No.1-State has been filed. The same is made part of the record. Learned State counsel, on instructions from ASI Praveen Kumar, concedes that petitioner had joined investigation and further custodial interrogation of the petitioner is not required.

Considering the entire facts and circumstances of the case, as enumerated above, but without commenting on merits, order dated 28.04.2026, granting interim anticipatory bail to the petitioner is made absolute, subject to conditions laid down in Section 482(2) Bhartiya Nagarik Suraksha Sanhita, 2023.

All the pending miscellaneous applications, if any, stand disposed of.
