The petitioners seek the prayer for absorption as regular constables on account of the fact that they have been found suitable. It is the case of the petitioners that they were not being granted the necessary benefit on account of the pendency of the criminal proceedings. It is their case that since they were working as SPOs, they had been denied the relief of absorption on account of the said criminal prosecution, which have now ended in acquittal. Their appointment as Constables had been recalled on account of the policy dated 11.05.2009. In view of the detailed reasons given in judgment of even date passed in CWP No. 14975 of 2009, Pawan Kumar (Constable) vs. State of Punjab and others, the order recalling the appointments is quashed. Accordingly, directions are issued to respondent no.

2 to consider the case of the petitioners for absorption as Constables within a period of 3 months from the date of receipt of certified copy of the order after taking into account the acquittal orders which have been passed in their favour. It is, however, made clear that the petitioners will not be entitled for any monetary benefits during the period they remained out of service. 13.01.2016 (G.S.
