The learned counsel for the petitioner submits, that in case the respondents concerned, are directed to, within two months hereafter, complete the investigations into FIR No. 528 of 12.10.2020, which was registered at Police Station Sector 5, Panchkula, constituting therein offences under Sections 306/34 of the IPC, thereafter, he has instructions, to withdraw the petition.

The afore made prayer is not opposed by the learned State Counsel.

Consequently, the petition is disposed of with a direction to the official respondents to conclude, within three months hereafter, further investigation, as, are underway, in the FIR (supra). Upon conclusion of the above investigation, the Investigating Officer (IO) concerned, may either depending upon the worth of the evidentially material, as, becomes collected by him, file a cancellation report before the learned Magistrate concerned, or may proceed to file an affirmative report report under Section 173 of the Cr.P.C., before the learned Magistrate concerned. It is clarified that in case the IO concerned, proposes to file a closure report, and his / her proposal is accepted by the superior authorities concerned, and, thereafter it becomes instituted before the learned Illaqa Magistrate concerned, thereupon, the complainant concerned, shall be afforded an opportunity to make a protest against its acceptance, by the learned Magistrate concerned.
