The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.118 dated 18.10.2018 registered for the offences under Sections 302 and 34 IPC at Police Station Mahilpur, District Hoshiarpur.
I have heard learned counsel for the petitioner and have gone through the record.
The FIR in the present case has been registered on the basis of eye witness account. The present petitioner is named in the FIR and it has been stated that he caused injuries to the husband of the complainant on 29.9.2018 and he was taken for treatment to private doctor. On 5.10.2018, the health of husband of the complainant deteriorated due to injuries and he was got admitted to Civil Hospital, Garhshankar. Then he was taken to HARPAL SINGH PARMAR 2018.12.06 10:30 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-53576 of 2018 [2] Guru Nanak Mission Hospital, Daha Kalera and from there he was referred to PGI, Chandigarh. The husband of the complainant did not recover there also and the doctor lost all hopes of his survival and asked them to take him back home and they brought him back home and on 18.10.2018 the husband of the complainant died due to the injuries. The present petitioner is named in the FIR and specific injuries are attributed to him. The petitioner is required for custodial interrogation. Otherwise also, keeping in view the nature and gravity of the offences, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
