NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 243 dated 10.08.2023 (Annexure P-1) registered under Sections 354-A and 506 IPC and Section 8 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Rai, Sonipat.
Learned counsel for the State has filed custody certificate dated 28.05.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 03 months and 06 days.
After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel submits that he may be permitted to withdraw the instant petition, at this stage.
Permitted to do so.
