The present petition has been filed under Article 226 of the Constitution of India read with Section 3, 12(5) & (11) of the Haryana Good Conduct Prisoners (Temporary Release) Act, 2022 for issuance of writ in the nature of certiorari for quashing the impugned order dated 30.01.2025 bearing reference No. 1104 (Annexure P-1) passed by respondent No.2 whereby application of release of the petitioner on regular parole was dismissed. 2.

Learned counsel for the petitioner submits that the petitioner has been undergoing life imprisonment since 17.01.2006. He had applied for parole which was rejected solely on the ground that he had been convicted in two murder cases. He further submits that his past conduct cannot serve as a permanent ground to deprive him of parole when he otherwise meets eligibility criteria under Haryana Good Conduct Prisoners (Temporary Release) Act, 2022.

Ms. Ankita Ahuja, AAG, Haryana accepts notice on behalf of the respondent-State. She submits that the petitioner is "hardcore" prisoner as defined in the Act and he is involved in six more other cases. Moreover, when the petitioner was out on parole, he involved himself in another FIR under Section 307, IPC therefore his parole may be rejected. 5.

I have heard the learned counsel for the parties and perused the record.

This Court is of the view that the petitioner during his parole did not keep good conduct and has involved himself in another FIR. Therefore, this Court does not find any legitimate ground to interfere in the impugned order dated 30.01.2025 bearing reference No. 1104 (Annexure P-1) passed by respondent No.2.

Hence, present petition stands dismissed.
