**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 39 dated 16.2.2018 registered at Police Station Civil Line, Sonipat, District Sonipat under Sections 376, 313, 506, 34 IPC.

Counsel for the petitioner contends that petitioner is in custody since 19.2.2018 and charge has been framed. Counsel further submits that complainant is a married woman and in her complaint she had stated that her husband's whereabouts were not known and she has referred to a relationship with the petitioner and is now alleging rape and forcible abortion.

State counsel informs that in the medical record, there is no history given by the complainant that she was forcibly made to consume tablets which led to her abortion.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate on the condition that he would not contact the prosecutrix or tamper with evidence in any manner.
