The petitioner filed a writ petition seeking release of General Provident Fund and Group Insurance Scheme as the same were not released at the time of retirement on 28.02.2017. Prayer was made to release the benefits with the interest @ 12% per annum. The writ petition was disposed of on 04.12.2018 with the directions to consider the case of the petitioner claiming interest by passing a speaking order.

During the pendency of the writ petition, the retiral benefits were released, the only issue remained was with regard to interest on the delayed payment.

Learned counsel for the petitioner states that needful was not done keeping in mind the judgments of this Court in A.S. PANKAJ BAWEJA 2019.12.12 09:30 I attest to the accuracy and integrity of this document High Ciourt, Chandigarh

COCP No.2069 of 2019 -2Randhawa Vs. State of Punjab and others, 1997(3) SCT 468 and J.S. Cheema Vs. State of Haryana 2014(13) RCR (Civil) 355. Reply dated 30.07.2019 filed today in the Court, is taken on record, copy handed over to learned counsel for the petitioner. Alongwith the reply, orders dated 10.07.2019 and 19.07.2019 are annexed.

Learned State counsel submits that claim for interest has been accepted and amount found due has been paid to the petitioner.

In view of reply filed, learned counsel for the petitioners states that no cause of action survives for pursing the contempt petition, however, seeks liberty to avail remedies in accordance with law.

The contempt petition is disposed of with liberty as prayed for.
