**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.13 dated 22.02.2016, under Section 376 IPC, registered at Police Station Harike, District Tarn Taran.

Learned counsel for the petitioner submits that the complaint made by father of girl Jawant Singh and thereafter, the matter was enquired into by DSP, Patti, in which, it was found that 55 times calls were exchanged between mobile phones given by Gurpreet Kaur and Satnam Singh and she has gone with petitioner Satnam Singh with her consent. In the statement made by daughter of complainant under Section 164 Cr.P.C. she specifically named Jeeta and Balwant Singh, who were not challaned by the police. Moreover, the anticipatory bail was granted to co-accused of the Naresh Kumar 2017.01.25 13:54 I attest to the accuracy and integrity of this document Chandigarh petitioners, vide order dated 10.01.2017 passed in CRM-M-45120-2016 on

CRM-M-761-2017 -2the ground that they were neighbours of complainant and were not present at the time of incident.

Learned State counsel, on instructions from investigating officer, has informed that out of total 21 witnesses, only 6 witnesses have been examined so far.

I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 22.02.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Tarn Taran.

Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
