In this regard, it is submitted that prior to filing the present appeal, another appeal bearing case No. CRA-S1286 of 2020 against the same judgment of conviction and sentence order dated 19.12.2019 passed by Additional Sessions Judge, Moga is pending Admitted before this Hon'ble Court. Criminal Appeal No. S- 1319 of 2020 (O&M) present appeal i.e. CRA-S-1319 of 2020 is the duplicate appeal of CRA-S-1286 of 2020.

Since it has been directed by the authorities not to return/deregister the case to the Ld. Counsel and same is to be placed before the Hon'ble Bench for kind notice. This fact may kindly be brought to the kind notice of the Hon'ble Bench at the time of hearing the aforesaid application".

Learned counsel for the appellant also admits that another criminal appeal i.e. Criminal Appeal No. S-1286 of 2020, against the judgment of conviction and order of sentence, filed by the appellant, is pending. He, hence, prays for permission to withdraw the present appeal. Ordered accordingly.
