The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.131 dated 19.9.2018 registered for the offences under Sections 395, 353, 186, 148 and 149 IPC; Sections 134 and 135 of the Representation of People Act, 1957 and Section 3 of Prevention of Damage to Public Property Act, 1984 at Police Station Dayalpura, District Bathinda.
I have heard learned counsel for the petitioner and have gone through the record.
A perusal of the record shows that vide order dated 2.11.2018, the co-ordinate Bench of this Court has dismissed the anticipatory bail petition of the present petitioner and it has been specifically held in the order that the petitioner is required for custodial interrogation. Cr. Misc. No.M-53717 of 2018 [2] ground has been shown as to how the petitioner is not required for custodial interrogation now. The facts and reasons have been given in the earlier order regarding dismissal of the bail petition of the petitioner by the Coordinate Bench. As no new ground has been mentioned nor anything has been shown as to why the petitioner is not required for custodial interrogation, therefore, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.
Therefore, finding no merit in this petition, the same is dismissed.
