(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No. 4 dated 07.01.2018 (Annexure P-1) registered under Sections 307, 326, 148 and 149 IPC (Section 307 IPC has been deleted vide enquiry report Annexure P-2) and Sections 25 and 27 of the Arms Act at Police Station B-Division, Amritsar and all subsequent proceedings arising therefrom, on the basis of compromise dated 20.07.2018 (Annexure P-3) effected in between the parties. Pursuant to order dated 06.12.2018 of this Court, the parties appeared before the Judicial Magistrate Ist Class, Amritsar, on 10.12.2018 to get their statements recorded. Learned Judicial Magistrate Ist Class, Amritsar, has submitted her report vide letter No. 26 dated RISHU KATARIA 2019.03.05 18:38 I attest to the accuracy and integrity of this document

CRM-M-53724-2018 -224.01.2019, duly forwarded by learned District and Sessions Judge, Amritsar, vide Endst. No. 837R dated 25.01.2019. According to the report, learned Judicial Magistrate Ist Class, Amritsar, is satisfied that compromise effected between the parties is without any pressure, duress, inducement and threat of any kind from any corner voluntarily with their free will.

In compliance of order dated 01.02.2019, original receipts regarding deposit of costs of ` 15,000/- have also been produced in Court today. The same are taken on record. Be tagged at appropriate place. Considering the report of learned Judicial Magistrate Ist Class, Amritsar, dated 24.01.2019 and deposit of costs as well as the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No. 4 dated 07.01.2018 (Annexure P-1) along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
