NIDHI GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for quashing the impugned order dated 01.07.2016 (Annexure P-1) passed by the learned Judicial Magistrate Ist Class, Hisar in Case No. 55-I dated 09/24.07.2015 titled as 'Suman Rani vs. Saurabh and other', declaring the petitioner as proclaimed offender.
Upon notice, respondent No. 1-State has filed status report dated 24.05.2023 by way of affidavit of Sh. Kaptan Singh, HPS, Deputy Superintendent of Police, Law and Order, Hisar. In para 5 of the aforesaid status report, it has been averred that after declaring the petitioner as proclaimed offender vide impugned order dated 01.07.2016 (Annexure P-1), FIR No. 37 dated 21.01.2019 under Section 174-A IPC, Police Station Sadar, Hisar was registered against the petitioner. Vide order dated 11.06.2019, the learned Additional Chief Judicial Magistrate, Hisar, convicted the petitioner RISHU KATARIA 2023.09.15 17:09 I attest to the accuracy and authenticity of this order/judgment
CRM-M-53726-2018 -2- 2023:PHHC:121520 under Section 174-A IPC and sentenced him to undergo imprisonment from 22.01.2019 to 28.01.2019 with a fine of Rs.3000/-. In view of the above, learned counsel for the petitioner submits that the present petition has been rendered infructuous and may be disposed of, as such.
