Rajan Gupta, J (Oral) Petitioner has prayed a writ in the nature of mandamus to direct the respondents for expeditious disposal of disciplinary proceedings and for refund of amount of Rs.95666/- from the respondents. Learned counsel for the respondents at the outset submits that disciplinary authority decided the matter during the pendency of this petition and order dated 11.9.2013 was passed. Against the said order, petitioner has preferred an appeal which is pending before the appellate authority.
In view of above, this petition is disposed of with a direction that in case any appeal is pending before the appellate authority, same be decided expeditiously not later than 4 months. Respondent shall thereafter consider representation Annexure P/5 made by the petitioner and pass a speaking order thereon.
