Petitioner-Gian Singh has filed this 3rd petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.145 dated 10.06.2015, registered at Police Station City Barnala, under Section 21, 25 and 29 of
Notice of motion has been issued.
Mr. Deep Singh, Asstt. Advocate General, Punjab, has put in appearance on behalf of the respondent-State and contested this petition. Police record produced by the learned State counsel has also been perused.
I have heard learned counsel for the petitioner as well as Rajesh Kumar 2017.01.25 11:21 I attest to the accuracy and authenticity of this document.

CRM-M-769-2017 learned State counsel and have gone through the record. From the record, I find that vide order dated 04.08.2016, passed by this Court, regular bail application filed on behalf of the petitioner was dismissed while holding that recovery of 300 grams of heroin effected from the present petitioner falls in commercial quantity. In the said order, this Court has also given a direction to the learned trial Court to expedite the trial by giving short adjournments. Today, learned State counsel has apprised this Court that 11 witnesses since then have been examined before the learned trial Court. Keeping in view the above fact that 11 witnesses have already been examined and the trial Court is conducing the trial expeditiously, therefore, no ground is made out to grant regular bail to the petitioner, especially in view of the bar of Section 37 of
