It being so, the present application for transfer of petition under Section 13 of the Hindu Marriage Act, 1955 has become infructuous. The same is dismissed with the observations that in case the respondent backs out from the compromise and does not withdraw the divorce petition, the applicant shall have a right to approach the Court again for transfer of the petition in question.
