Learned counsel for the petitioner has pleaded that the deceased has made oral dying declaration before the petitioner, namely Rajesh that he has been forcibly administered poison by respondents No.2 & 3 but the trial Court has wrongly charged them for the offences punishable under Section 306 IPC.

At the same time, learned counsel for the petitioner pleads that the statement of petitioner-Rajesh, as complainant in the case, is yet to be recorded by the trial Court. He prays that he may be permitted to withdraw the present petition with liberty to the petitioner to move appropriate application for alteration of the charge before the trial Court after the statement of the complainant, if the material to amend the charge comes on record.
