Naresh Kumar Sanghi, J.(Oral) Learned counsel for the petitioner fairly concedes that at the time of moving of the application under Section 319, Cr.P.C., there might not be the sufficient material to summon the additional accused. Further prays that he may be relegated to move fresh application if additional material emerges on record showing the involvement of the proposed accused. Disposed of with a direction that if the fresh application under Section 319, Cr.P.C. is presented at a later stage, the same shall be decided as per law.
