Revision is directed against framing of the charge under Section 304 IPC, since it is submitted that there was no intention. It is apparent that as per allegations the petitioner was driving his truck on the wrong side of the road and therefore, can be safely attributed knowledge that the said act is likely to cause someone's death and therefore,offence under Section 304 IPC would be attracted.

After arguing for sometime and having failed to convince the Court,learned counsel seeks permission to withdraw the present petition.

Dismissed as withdrawn.
