 /  . The present habeas corpus petition has been filed directing the official respondents to get the detenue namely Varsha released from unlawful custody of respondent No.4-Arshdeep Singh.

Counsel for the petitioner was asked to verify as to whether any protection petition has been filed by Arshdeep Singh before this Court. When the case was called second time, counsel for the petitioner informs that CRWP-4025-2026, titled as 'Arshdeep Singh and another Vs. RAJ KUMAR ARORA 2026.04.23 17:48 I attest to the accuracy and integrity of this document

 

  

State of Punjab and others' for seeking protection had been filed by Arshdeep Singh. The said writ petition was disposed of vide order dated 16.04.2026. Learned counsel for the petitioner contends that a misrepresentation had been made by respondent No.4 in the aforesaid petition. It was stated that both i.e. Arshdeep Singh as well as Varsha (minor daughter of the petitioner herein) are major and are in live-in relationship. In support of his argument, counsel for the petitioner places reliance on the Aadhaar Card of Varsha to contend that Varsha is a minor and her date of birth is 13.11.2008.

Having heard counsel for the petitioner and going through the record, I am of the opinion that a wrong representation has been made by the respondent No.4 as well as Varsha in proceedings before a Coordinate Bench of this Court by way of CRWP-4025-2026. In such an eventuality, any grievance emanating from wrong pleadings can be addressed only by way of moving an application before concerned Court in the same writ petition. Faced with the above, counsel for the petitioner does not press the instant petition at this stage so as to take recourse to the alternative remedies available to the petitioner in accordance with law. Disposed of as withdrawn with liberties as aforesaid.   01&2
