Through this petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner-Kuljeet Singh @ Sonu, in case FIR No. 209 dated 15.08.2018 registered under Section 15 of the NDPS Act at Police Station City, Kapurthala.
According, to the prosecution, on 15.08.2018, the petitioner was found in conscious possession of 56 Kgs. of poppy husk, which falls under the category of 'commercial quantity'.
Learned counsel inter alia contends that petitioner has falsely been implicated in the instant case. The alleged recovery was effected from truck bearing registration No. PB-02-CR-7655. The RISHU KATARIA 2018.12.20 11:56 I attest to the accuracy and integrity of this document
CRM-M-53858-2018 -2petitioner was not apprehended at the spot. There is no direct or indirect evidence against the petitioner to connect him with the commission of crime.
On the other hand learned State counsel vehemently oppossing the submissions of learned counsel for the petitioner contends that the petitioner is involved in two more cases of similar nature. In view of the above and keeping in view the fact that drug trafficking in this Northern region of the country has increased manifold in the recent past and, thus, such type of crime has to be dealt with severe hands, the instant petition is dismissed.
