In the present petition, the petitioner-institution is claiming that late fee for the registration of the candidates for class IXth and class XIth for the session 2024-25 demanded by respondent No. 2-CBSE from the petitioner-institution which was paid by the petitioner-institution, is without jurisdiction hence, the respondents are liable to be directed to refund the same.

Learned counsel appearing on behalf of the petitioner-Institution submits that though, the late fee for the registration of the candidates for class IXth and class XIth for the session 2024-25 was to be paid by the petitioner-institution starting from 18.10.2024 (Annexure P-A) but the petitioner-institution had paid the said fee on 17.10.2024 and hence, the same RIYA 2025.05.03 13:21 I attest to the accuracy and integrity of this document

I have heard learned counsel for the petitioner and have gone through the case file with his able assistance. 4.
A bare perusal of the schedule which was given in the Annexure attached to the registration data of the candidates for class IXth and class XIth for the session 2024-25 dated 11.09.2024, copy of which has been annexed as Annexure P-2, the said registration could have been done without late fee upto 16.10.2024.
It is a conceded position that the said registration was not done by the petitioner-institution upto 16.10.2024 and any registration applied after 16.10.2024 has to be dealt with late fee, hence, the charges of late fee demanded from the petitioner-institution by respondent No. 2-CBSE cannot be treated as arbitrary and illegal in the facts and circumstances of the present case.
Pending civil miscellaneous application, if any, stands disposed of.
