(Oral) Present petition has been filed under Section 439 Cr.P.C. for grant of regular of bail to the petitioner in FIR No.983 dated 02.10.2015, under Sections 294, 323, 354, 376 IPC and Sections 23 of the J.J. Act and 4 of the POCSO Act, registered at Police Station Sadar Hisar, District Hisar. Pursuant to order dated 30.03.2017 of this Court, reply by way of affidavit of Assistant Superintendent of Police, Hisar, has been filed, today in the Court.

As per the said reply, on 17.11.2012 when the prosecutrix was found, she was sent to the Krishan Parnami Bal Sewa Ashram, Kaimri Road, Hisar, which was registered. The said Ashram was registered for the period 11.09.2012 to 10.09.2013 and its registration had not been cancelled during the said tenure. As per letter (Annexure R-2), Ashram was provisionally registered at that time.

CRM-M-7832-2017 -2Learned State counsel, on instructions from the investigating officer, has informed that the trial is fixed for 25.05.2017 for recording the defence witnesses.

Heard learned counsel for the parties.

Keeping in view the seriousness of the allegations, the petitioner is not entitled to the concession of regular bail, at this stage and accordingly the present petition for regular bail filed by him is hereby dismissed.

Needless to mention that nothing observed, here-in-above, would reflect, in any manner, on merits of the main case, as the same has been so recorded for a limited purpose of deciding the present petition for regular bail.
