***** HARSH BUNGER J. (ORAL) The present petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for directing respondent No.2 to re-issue/renew the passport of the petitioner.

During the course of hearing of the instant writ petition, it was pointed out by learned counsel appearing for the respondents/Union of India that vide letter dated 20.01.2025 (Annexure P-9), the application for issuance of passport submitted by petitioner was returned to him with following observations:- "Your incomplete/incorrect application is being sent back due to

-2the following reason/s:

 1 Picture of size 51 mm X 51 mm is required. Please follow the link for picture specifications:

https://www.hciottawa.gov.in/pdf/PhotoSpecification.pdf  Consulate approval required on FIR (0014/22 July 2023) mentioned on reissue application form.

 Current status proof in Canada is required. We are sending back the following original documents along with the application;

 DRAFT, PPT You may complete your application and Re-submit along with a Copy of this Letter & Above-Mentioned Documents (Please refer to BLS website to ensure you have correctly filled up your application along with correct Document & Fees, as mentioned on BLS website) You may come as a walk-in to BLS centers to Re-submit your application, or book courier pickup by calling BLS customer service at +1647-846-4077."

2.1 It is submitted that the petitioner has not submitted the complete application.

In response, learned counsel for the petitioner submits that the petitioner has already submitted a complete application, however, no document reflecting the aforesaid assertion on behalf of the petitioner is forthcoming.

Faced with this situation, counsel for the petitioner prays for withdrawal of the instant writ petition at this stage, so as to enable the petitioner to submit a complete/correct application in terms of letter dated 20.01.2025 (Annexure P-9), if not already done. 5.

Keeping in view the aforesaid submission of learned counsel for the petitioner, present writ petition is dismissed as withdrawn with liberty
