  Prayer in the present petition is for setting aside the order dated 16.11.2019 passed by Judicial Magistrate 1st Class, Jalalabad whereby the petitioner has been declared as a proclaimed person in case bearing NACT No.343 of 2017 dated 22.08.2017 under Section 138 of the Negotiable Instruments Act, 1881.

Learned counsel for the petitioner contends that pursuant to the order dated 02.06.2023, not only the petitioner has deposited the cost of Rs.20,000/- to be paid to respondent No.2, he has also surrendered before the trial Court and was enlarged on bail.

The interim order dated 02.06.2023 is made absolute on the statement of counsel for the petitioner, however, if the aforesaid statement is found to be factually incorrect, the parties shall be at liberty to seek rehearing of the present petition. Disposed of.
