Learned State counsel submits that out of fourteen witnesses cited by the prosecution, nine have been examined and two have been given up. Prosecution shall endeavor to conclude its evidence at the earliest. In view of above, learned counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to file afresh in case trial does not conclude within a period of four months. Dismissed as withdrawn with aforesaid liberty. As the main petition has been dismissed as withdrawn, no order needs to be passed in the accompanying application.
