**** RITU BAHRI , J. (Oral) The present petition is for quashing of order dated 22.07.2015 and 24.05.2016 whereby the applications of the petitioner/prosecuting agency under Section 319 Cr.P.C seeking summoning of respondent Nos. 2 to 5 has been dismissed.
A bare perusal of order dated 22.07.2015 and 24.05.2016 shows that initially challan was presented against accused Suresh Kumar, Vinod Kumar and Kulwant Singh @ ghanti but later on the complainant has named accused Kashmir Singh, Surinder Singh Saini, Ranbir Singh, Thomas, Andrew, Daniel, Dennis and Davis in her statement made before the Court and the Court below vide order dated 22.07.2015 partly allowed the application and summoned accused Kashmir Singh, Surinder Singh Saini, Ranbir Singh & Thomas. Thereafter, again an application was filed to summon accused Andrew, Daniel, Dennis and Davis on the ground that since the joint application filed by them for anticipatory bail has been GAURAV ARORA 2016.08.19 16:03 I attest to the accuracy and integrity of this document
CRR No. 2494 of 2016 dismissed on 25.04.2014 on the ground that the injuries attributed to the accused are of serious in nature, they be summoned. But the Court below has rightly dismissed the application on the ground that merely on the ground that anticipatory bail application of respondent Nos. 2 to 5 has been dismissed, this cannot be made a ground to summon them and the relief sought by the complainant has already been considered and dealt while partly allowing the application on 22.07.2015. No ground is made out to interfere in the order dated 22.07.2015 and 24.05.2016.
The revision petition stands dismissed.
