**** ANOOP CHITKARA, J. (Oral) Aggrieved by order dated 22.09.2016 (Annexure P-2), vide which the Additional Sessions Judge, Panchkula had granted bail to the respondent-accused, State had come up before this Court under Section 439(2) CrPC for cancellation of bail. In the interregnum, the matter was transferred to CBI and as such, now, CBI has become the prosecutor.
Counsel appearing for the respondent-accused submits that the respondent has cooperated with the prosecution in every manner and has not violated any condition of the bail and therefore, the bail granted to the petitioner be not cancelled. He has no objection to comply with any stringent condition(s) which this Court may impose, if necessary. He further submits that order dated 13.1.2023 has already been complied with.
Bail was granted to the respondent-accused on 22.9.2016 and a period of about 6 years and 6 months has elapsed. There is no allegation that the accused has tempered with the evidence in any manner or influenced the investigation. Thus, there is no reason to send the respondent-accused behind bars.
