Mr. Apoorv Garg, learned Deputy Advocate General, Haryana, has joined the proceedings in this case, in pursuance of the notice of this petition having been sent to the respondent-State in advance.
I have heard learned counsel for the petitioner as well as learned State counsel in this petition and have also perused the file thoroughly.
Learned counsel for the petitioner argues that the petitioner has been falsely implicated in this case and he is in custody since NEETU RANI 2021.08.16 16:01 I attest to the accuracy and integrity of this document PHHC
CRM-M No.32088 of 2021 -2- .....
25.12.2019 and the trial of the case will take long time to conclude as only a few witnesses have been examined by the prosecution before the trial Court and therefore, the petitioner deserves the relief as prayed for in this petition.
However, learned State counsel apprises the Court that out of total 28 witnesses as intended to be examined by the prosecution in this case, one witness has been examined till date but he argues that in view of the gravity of the offence as committed by the petitioner, this petition deserves dismissal.
Keeping in view the facts that the petitioner is behind the bars since 25.12.2019 and the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Sunder Singh is ordered to be released on regular bail subject to his furnishing the requisite bail bonds and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
The instant petition stands allowed accordingly. (MEENAKSHI I. MEHTA) 16.08.2021 JUDGE neetu Whether speaking/reasoned Yes Whether Reportable No NEETU RANI 2021.08.16 16:01 I attest to the accuracy and integrity of this document PHHC
