The petitioner in the present petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is for setting aside the order dated 08.08.2024 (Annexure P-1) passed by learned Chief Judicial Magistrate, Chandigarh in complaint under Section 454 of the Companies Act in complaint case no.COMA/5481/2022 titled as Registrar of Companies, Punjab and Chandigarh at Chandigarh Vs. M/s. Prehari Protection Systems Pvt. Ltd. And Others whereby bail bonds of the petitioner were cancelled and his surety bonds were forefeited.

Learned counsel for the petitioner contends that the petitioner was facing trial in the aforesaid complaint case and was appearing regularly. However, on 08.08.2024 due to strike, Court premises were blocked and the petitioner could not appear before the Court and thereafter non bailable warrants were issued vide impugned order dated 08.08.2024. Although, he has no explanation as to why till date he could not appear before the Court, however, the petitioner now undertakes Sonia Puri 2025.05.06 15:54 I attest to the accuracy and integrity of this document

CRM-M No.23821 of 2025 -2-   to appear before the trial Court on each and every date of hearing and shall not seek exemption from his personal appearance, on any ground.  3.

Notice of motion.

On the asking of the Court, Mr. Amandeep Singh Samra, AAG, Punjab, accepts notice on behalf of the respondent-State. 5.

In view of the limited prayer made by the learned counsel for the petitioner, the instant petition is disposed of subject to the condition that the petitioner shall surrender before the Court concerned at 10:00 am within 07 days from the date of receipt of this order. In case, on appearance and surrender, the petitioner moves an application for bail, the Court concerned shall decide the same on the same very day, in accordance with law. 6.

It is made clear that in case, the petitioner fails to surrender before the Court concerned within the given period of time, this order shall be of no avail to him thereafter.

The petition stands disposed of.
