Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to decide the representation (Annexure P-5) and implement the orders dated 19.05.2025, 10.06.2025, 18.06.2025 (Annexures P-6 to P-9) to grant compassionate appointment to the petitioner on account of death of her husband during the service, in accordance with the Deployment of Contractual Persons Policy, 2022 dated 30.06.2022 (Annexure P-3) and amendments thereto dated 13.05.2025 (Annexure P-4) issued by the Government of Haryana.

On 27.04.2026, the following order was passed:-

Learned counsel for the petitioner, inter alia, contends that late husband of the petitioner was working as ALM (Haryana Kaushal Rozgar Nigam Limited) in the respondent-Nigam and on 21.01.2025, while on duty, he got electrocuted, which proved fatal and due to same, he passed away. Further, in Clause 12 of the Deployment of Contractual Persons Policy, 2022 and amendments thereto issued by the Government of Haryana, it is provided that in case of death while in contractual service, the family of the deceased employee may either opt for compassionate financial assistance of Rs.3.00 lakhs or compassionate appointment to the job.

It is further contended that the petitioner submitted a representation in May, 2025 (Annexure P-5) seeking compassionate appointment due to accidental death of her husband while on duty, which was forwarded to the Executive Engineer, DHBVN, Manesar vide letter dated 19.05.2025 (Annexure P-6) and the same was further forwarded to Nodal Officer (HKRN), DHBVN, Hisar. Thereafter, on 18.06.2025, Superintending Engineer 'Op', Gurugram-I forwarded the claim made by the petitioner in the aforesaid representation for further consideration and necessary action in view of the relevant government instructions, as discernible from the order (Annexure P-9). Despite this, the respondent-Nigam has been sitting on the representation (Annexure P-5) and failed to take any action regarding grant of compassionate appointment to the petitioner.

On advance notice, Mr. Divyansh Shukla, Advocate for Mr. Sukhdeep Parmar, Advocate appears on behalf of respondent No.2 and seeks short accommodation to have complete instructions in the matter.

Learned State counsel, on instructions, submits that the claim raised by the petitioner is under active consideration before the competent authority and appropriate order shall be passed within a period of four weeks.

Learned counsel for the petitioner, at this stage, submits that he is satisfied with the stand taken by learned State counsel and the instant petition may be disposed of.
