Present petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 605 dated 13.9.2016, registered under Section 379-A IPC, at Police Station City, Jagadhri. Learned counsel for the petitioner contended that petitioner has been falsely implicated in this case; he is in custody since 4.1.2017 and decision of the case still to take some more time. Thus, the petitioner be released on regular bail.

Learned counsel for the respondent-State contended that petitioner was involved in some other case under Section 379-A IPC but that case has already been decided, however, there are no grounds for releasing him on regular bail.

Criminal Misc. No. M-7995 of 2017 the parties; the fact that the petitioner is in custody since 4.1.2017; trial of the case still to take some more time and no useful purpose shall be served by detaining him in custody any further, the present petition is accepted. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Yamuna Nagar at Jagadhri.
