Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.337 dated 21.12.2016 under Sections 323/354/341/506/ 34 IPC (the offences punishable under Sections 341/506/34 IPC have since been deleted) registered at Police Station Salhawas, District Jhajjar. It is submitted that the petitioner has been falsely implicated in this case. The present FIR is a counter-blast to FIR No.298 dated 07.11.2016 under Sections 323/341/307/506/34 IPC registered at Police Station Salhawas in respect to the same incident. FIR No.298 dated 07.11.2016 was registered on the statement of the petitioner's brother against the complainant's brothers. CRM No.M-8 of 2017 [2] Three persons have been named in the present FIR No.337 dated 21.12.2016 however, two of them have been found innocent during investigation. Moreover, the petitioner has joined investigation therefore, this petition be allowed.

Learned counsel for the State, on instructions from SI Sri Krishan, verifies that the petitioner has joined investigation. It is submitted that custodial interrogation of the petitioner is not required. No recovery is to be effected from him.

There are no allegations on behalf of the State that the petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances as above but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 03.01.2017 is made absolute. ( LISA GILL ) March 24 , 2017.
