Learned counsel for the applicant-petitioner submits that he was having some internet connectivity problem on 10.11.2020 and the nonappearance was not intentional. He further submits that it is settled principle that no one should be condemned unheard. In support of his arguments, he had placed reliance on M/s Rimple Enterprises versus M/s A.S.S.G. Marketing Private Limited and others 2020(1) NIJ 553. Keeping in view the above and the grounds mentioned in the application, the same is allowed.
