The instant petition filed under Section 482 of BNSS for grant of anticipatory bail in FIR No.16 dated 10.02.2023 (Annexure P-1) registered with Police Station Sadar Tarn Taran, District Tarn Taran under Section 406 IPC. 2.

On 03.05.2025, this Court passed the following order: "Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- FIR Date Section Police District Name & age of No.

Allegations against the petitioner is that he being the driver of Innova Car bearing registration No.PB10-CM-0157, provided service to the complainant party, who had returned from Italy. Mistakenly, complainant forgot her handbag in the

car of the petitioner, containing passport, gold jewellery and currency notes. Immediately, after dropping the complainant, neither the mobile call was picked up by the petitioner nor the handbag was returned to the complainant by the petitioner. 3.

Counsel for the petitioner submits that no crime was committed by the petitioner, and therefore, even if the allegations are taken up correct on its face value, no criminal act, has been played at the instance of the petitioner by not returning of the handbag, as it was never entrusted to him by the complainant. Thus, prays for grant of concession of anticipatory bail to the petitioner in the present case. 4.

On advance notice, learned State counsel puts in appearance on behalf of the respondent - State, and seeks some time to respond to the submissions addressed by learned counsel opposite, after seeking instructions. And, in case of necessity, to file status report.

In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).

Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport. It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court.

Besides, on oral request of counsel for the petitioner, complainant - Sarabjit Kaur w/o Surinder Singh s/o Sh. Suraj Singh, r/o Village Bulle Nangal, Police Station Beas, District Amritsar, Mobile No.62808-62535, is hereby ordered to be impleaded as respondent No.2.

Counsel for petitioner is directed to file amended memo of parties in the registry within a period of three days from today, and upon doing so, let notice be issued to newly added respondent No.2 for the date fixed before this Court." 3.

Today State counsel on instructions from SI Ranjeet Singh submits that the cancellation report has already been prepared and same has already been submitted before the court of concerned Magistrate. Therefore, the instant petition can be disposed of, at this stage, as being not maintainable. 4.

In view of the submissions made by the learned State counsel present petition is disposed of, with a direction to the trial Court to decide the cancellation report expeditiously, and till then petitioner shall not be arrested in the instant case. However, it is also made clear that in case any adverse order is passed by the learned Magistrate, petitioner would be at liberty to seek revival of the present petition.

Petition stands disposed of.
